PharmaSpirit Terms and Conditions
These Terms and Conditions (“Terms”) govern the services provided by PharmaSpirit (“Company”) to individuals enrolling in the MCQ Prep Course (“Course”). By signing into this website, registering for a PharmaSpirit program, or accessing any services, you (“Participant”) agree to comply with these Terms.
Course Registration and Access
Upon registration, Participants gain access to the Course portal, which includes printable PDF materials, videos, recorded lectures, and a question bank. Access is limited to the registered Participant and cannot be shared, transferred, or sold. Any violation of this policy may result in termination of access without refund.
Payment Terms
- Full Payment
Payment for each Course is due upon registration. If a Participant chooses to pay by cheque, PharmaSpirit allows a pending period of seven business days. After this period, Participants who have not made the payment will be removed from the course list. No course materials will be provided until the cheque is cashed. Once payment is made, course materials will be mailed to Participants. - Installment Payment
If a Participant opts for installment payments, the full course fee must be paid in accordance with the agreed installment schedule. Materials will only be provided once 60% of the course fee is paid. Participants must ensure timely payment for each installment. Failure to pay on time may result in removal from the course list and loss of access to course materials.
Extension Policy
PharmaSpirit provides a one-time extension for re-access to the Course portal, if a Participant cannot take the MCQ exam after completing the Course. This extension is provided at no additional cost, if requested within one year of registration and before the start of the next session. Two sessions are held annually, one in January and the other in July. The extension includes original materials only and does not cover:
- Re-attendance of live sessions
- Access to updated materials
Upon completion of the Course and the free extension, Participants will lose access to all online materials, this includes online access to management and therapeutics materials, therapeutics video, recorded management lectures and the practice question portal. Re-attendance or re-access access to the course portal, after Participants have used up their free extension, are available only through paid enrollment. This offer does not apply to Participants who have taken the MCQ Exam or who have taken a retake Course with PharmaSpirit.
MCQ Exam Retake Policy
Participants who fail the MCQ exam after taking the MCQ Prep Course with PharmaSpirit may retake the course in the following session at no additional cost, provided the request is made within one year of registration. For example, participants enrolled in the January course can attend the following July course at no charge, if they meet the eligibility requirements. To be eligible for the retake, the following conditions must be met:
- Completion of Course Materials: The Participant must have completed at least 95% of the course materials available on the course portal.
- Proof of Failure: The Participant must provide proof of failing the exam after completing the course.
Important: If the Participant opts not to provide proof of exam failure or fails to meet the conditions outlined above, they forfeit their privilege to retake the course with PharmaSpirit.
The retake is strictly non-transferable and is strictly limited to the original registered Participant who enrolled in PharmaSpirit; it cannot be transferred to a family member, spouse or any other individual. Only one retake is permitted per participant.
Cancellations and Withdrawals
In the event of an emergency where a lockdown is imposed, all in-class courses will switch to online learning. No refunds will be granted under these circumstances. Additionally, no refunds are provided for the OSCE prep course, the OSCE drop-in session, the OSCE mock exam, or the MCQ question bank.
1. Cancellation by PharmaSpirit
PharmaSpirit reserves the right to cancel a course due to low enrollment or unforeseen circumstances. If a PharmaSpirit decides to cancel a course, the refund will depend on when the cancellation occurs:
- Before accessing materials: If the cancellation occurs before Participants access any course materials (including the course portal or online materials), they will receive a full refund. If books have been printed, the price of the books will be deducted from the refund.
- After accessing materials: If the Participant has accessed course materials, no refund will be provided for the materials. Only the live lecture portion will be refunded, based on how much of the live lectures have been completed.
2. Cancellation by Participant
Once the course portal has been accessed, the Participant will no longer be eligible for a refund. However, if the Participant paid by e-transfer, cash, or cheque and has not yet accessed the portal, they may still be eligible for a refund, minus an administrative fee. If books have been printed, the price of the books will be deducted from the refund along with the administrative fee.
In extreme emergencies, with PharmaSpirit’s approval, Participants may carry over their payment to the next course session. For example, if a Participant pays for the January MCQ prep course and cannot attend, they may attend the July classes instead. In this case, PharmaSpirit must be notified immediately,in order for a postponement to be considered. Any request for postponement will not be considered after the course has ended.
Discounts
PharmaSpirit offers certain discounts to previous participants who take other courses with us, such as MCQ participant who wish to take our OSCE prep course. Discounts are not transferable and cannot be combined with other discounts. PharmaSpirit reserves the right to cancel discounts if an alternative payment arrangement has been made. Discounts are only valid at the time of registration.
Participant Expectations
- Preparation and Participation
Participants are expected to be prepared for each class by completing any required pre-readings and actively engaging with the course materials. Participants must watch all videos available on the course portal. - Missed Classes
If a Participant misses a class, they will not be allowed to attend a future live session to make up for it. Although classes are recorded, PharmaSpirit cannot guarantee the availability or quality of these recordings due to potential technical issues. Recordings are provided as an extra benefit, not a requirement of the course. If a recording is unavailable, PharmaSpirit will not repeat the class or provide access to other live sessions. Instructors will be available via email to address any questions regarding missed material.
Confidentiality Policy
Upon registration, Participants agree to keep all PharmaSpirit methods, materials, cases, and techniques confidential. Participants may not duplicate, take pictures, or make video or audio recordings of class or pre-class materials, nor may they lend, share, or disclose these materials or use them for any purpose outside of the Course. The documents, materials, and content provided, including but not limited to course materials, recorded lectures, and resources, are the sole property of PharmaSpirit. These materials are provided exclusively for educational purposes within the Course and must not be used or shared outside of this scope. Violations may result in suspension or termination without refund, and PharmaSpirit reserves the right to seek damages or injunctive relief for breaches.
Suspension or Termination
PharmaSpirit reserves the right to suspend or terminate services if a Participant engages in behavior that breaches industry standards, including unauthorized reproduction of materials, lectures, or seminars, disruptive activities, or unlawful actions. This includes failure to exercise the standards of care and diligence expected from recognized educational organizations, such as fraudulent copying, aggressive or unlawful behavior within PharmaSpirit’s premises, or with its employees, instructors, directors, or agents. In the case of suspension or termination, no refunds will be provided, and PharmaSpirit shall not be liable for any delays, losses, damages, or expenses incurred as a result.
Limitation of Liability
PharmaSpirit makes no warranties or representations regarding exam outcomes. PharmaSpirit is not endorsed by or affiliated with the Pharmacy Examining Board of Canada (PEBC) or other regulatory organizations. PharmaSpirit is not liable for any indirect, incidental, or consequential damages related to this agreement. In the event of any claims, PharmaSpirit’s total liability shall not exceed the fees paid by the Participant for the Course.
Privacy Policy
PharmaSpirit ensures that its Services meet the standards of care and diligence of recognized organizations offering similar services. PharmaSpirit is committed to protecting your privacy. We will only collect, use, and store your personal information as required for course registration and communication. Your personal information will not be shared with any third party without your consent.
Governing Law
These Terms shall be governed by, and construed and enforced in accordance with the laws of the Province of Ontario and the laws of Canada. Both parties agree to submit to the exclusive jurisdiction of the courts of Ontario.
